I. Information You Provide and Suggestic Collects

Suggestic provides a set of tools to help End Users follow and learn about select diets and dietary programs (the “Service”). The Service is intended solely as a tool to assist you in understanding and managing nutrition and wellness related information, including researching references, diets and recipes. Suggestic makes an effort to aggregate information from third-party sources but it does not guarantee this information is right for you, accurate, complete or up to date.

In addition, the information contained in this Service should only be utilized as a reference resource. This Service does not endorse diets, interventions, restaurants, foods, drugs, diagnose patients, or recommends therapy or interventions. This Service is a reference resource designed as supplement to, and not a substitute for, the expertise, skill, knowledge, and judgement of healthcare practitioners in patient care or nutrition or food warning labels.

The absence of a warning for a given nutrient, food, allergen, restaurant, diet, intervention or combination thereof in no way should be construed to indicate that the nutrient, diet, restaurant, ingredient or combination is safe, effective, or appropriate for any given user. Suggestic does not assume any responsibility for any aspect of healthcare administered with the aid of information provided by this Service. The information contained herein is not intended to cover all possible uses, directions, precautions, warnings, food interactions, allergic reactions, or adverse effects of diets, interventions, nutrients, ingredients or adherence to diets. A. Personal Information and Non-Identifying Information

When you create an account with us to use the Platform, we will ask you for personally identifiable information (“Personal Information”) and other information. Personal Information may include, but is not limited to, your name, username, phone number, email address, home address, and any other information that you are required or choose to provide to Suggestic that could be used to personally identify you.

We may also collect information that does not identify you (on its own), such as your zip code, gender, age, etc. and may combine it with other information for purposes of our operations or to share the information for purposes described below.

B. Usage Data

When you visit the Website, whether you are logged in or just browsing without logging in, our servers automatically record information that your browser sends whenever you visit a website. Similarly, when you log into the Platform using the Mobile App, our services automatically record information that the Mobile App sends. The information sent automatically by your browser and the Mobile App is referred to as “Usage Data.” This Usage Data may include information such as the manufacturer and model of your mobile device, your Internet Service Provider (ISP); your device’s Internet Protocol (“IP”) address (or other device identifier), browser type, and operating system; referring/exit pages; clickstream data; pages of the Website that you visit, the time spent on those pages or interacting with certain portions of the Mobile App, information you search for on the Platform, Website and Mobile App access times and dates; and other statistics.

We use this information to monitor and analyze use of the Platform, including for technical and administrative purposes, to increase the functionality and user-friendliness of the Platform, and to better tailor it to our End Users’ needs.

Additionally, Suggestic may use a “click-through URL” linked to content on the Platform. When an End User clicks onto one of these URLs, the End User will pass through our server before arriving at the destination webpage. Suggestic tracks this click-through data to help us monitor and analyze usage. We may also use clear gifs or pixel tags, which are tiny graphic images for operational purposes.

II. Collection of Information

Suggestic may use a number of different techniques and technologies to collect Personal Information, Non-Identifying Information, and Usage Data. For example, Suggestic may use cookies, log files, clear gifs, pixel tags, embedded scripts, and/or other technology used to monitor your Suggestic experience.

A. Cookies

As is regular practice on many websites, the Platform uses cookies and other technologies to help us understand which parts of the Platform are used and how. A cookie is a small amount of data that is sent to and stored on your device from our server. Cookies allow you, for example, to enter your password less frequently.

The Platform uses cookies to determine whether an End User is active and for other business purposes, such as cookies that send data directly to Suggestic and agents and contractors acting on behalf of Suggestic, The cookies on our Platform do not track Internet activity across different websites. Since cookies are now used as industry standard, most devices automatically accept cookies, but you may be able to change your device’s settings to decline them. If you prefer not to enable cookies, you may choose to disable them; however, please note that certain features on the Platform will not be available to you once cookies are disabled.

B. Usage Data

Usage Data is collected automatically by the Platform’s servers and software. For example, because the Website automatically collects Usage Data for all visitors and End Users that visit the Website, your Website session will be tracked. Additionally, the Mobile App collects Usage Data and sends it to the Platform servers to facilitate the Services provided to you through the Mobile App. You agree that we may collect and use technical data and related information, including technical information about your device, system and application software, and peripherals, to facilitate the provision of software updates, product support and other services to you related to the Mobile App.

II. Use and Sharing of Information

Use and Sharing of Information by Suggestic Suggestic’s policy is not to share the End User information it collects with third parties other than as specified below, or where an End User expressly consents to our sharing of certain information with a third party. We may share End User information with third parties under the following circumstances:

As required by law or an authorized government agency;

With subcontractors and vendors who perform services on Suggestic’s behalf for which the access or use of data is necessary, such as for maintenance purposes;

For business purposes, such as related to the acquisition or sale;

In response to a subpoena served on Suggestic;

To enforce or apply the Agreement;

To protect the rights, property, or safety of Suggestic, our End Users, or others;

To prevent activity that we believe, in our sole discretion, may be or may become illegal, unethical, or legally actionable (including exchanging End User information with other companies and organizations for fraud protection); and/or

For other purposes which in Suggestic’s discretion are deemed to be required by law or necessary to Suggestic’s business.

We cannot control the use of data by these third-parties.

IV. Changing or Deleting Your Information

All End Users who have created an account on the Platform may review, update, correct or delete the Personal Information in their registration profile by revising their account profiles. If you completely delete all such information, then your account may become deactivated. We may retain an archived copy of your records as required by law or for legitimate business purposes. Moreover, as per the rights granted by the 2018 General Data Protection Rule (GDPR) implemented by the European Union, you may request to delete and/or retrieve all your data via email at [email protected].

V. Security

We are very concerned with safeguarding your information and we use industry standard safety practices that also are in compliance with the 2018 GDPR. We employ administrative, physical, and electronic measures designed to protect your information from unauthorized access. For example, we use commercially reasonable security measures such as encryption, firewalls, and secure socket layers (SSL) to protect End User information.

Please note that no security system is impenetrable. Accordingly, we do not guarantee the security of our databases, nor that information you supply won't be intercepted while being transmitted to us over the Internet or other network. Any information you transmit to Suggestic, you do at your own risk. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (or similar data, as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting through the Platform in the most expedient time possible and without unreasonable delay, as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

For all users, including EU-citizens and EU residents, we will transfer your Personal Information to the United States in accordance with EU data protection law requirements by using model contractual clauses that have been approved by the European Commission or other appropriate means.

VI. Children’s Privacy

We are committed to protecting the privacy of children. Under the terms of the Agreement, End Users must be at least eighteen (18) years of age to access and use the Platform. Any access to or use of the Platform by anyone under the age of thirteen (13) is unauthorized, unlicensed, and in violation of the Agreement. By using the Platform, you represent and warrant that you are thirteen (13) years of age or older and that you agree to and agree to abide by all of the terms and conditions of the Agreement. If Suggestic believes that you are under the age of thirteen (13) or that you are not old enough to consent to and be legally bound by the Agreement, Suggestic may, at any time, in its sole discretion, and with or without notice: (i) terminate your access to or use of the Platform (or any portion, aspect, or feature of them), or (ii) delete any content or information that you have posted through the Platform.
